Copyright and DMCA Policy

Choo Choo Media Foundation, doing business as CCMF Trains ("we", "us"), respects
the intellectual-property rights of others and expects members to do the same. We
respond to clear notices of alleged copyright infringement consistent with the
U.S. Digital Millennium Copyright Act ("DMCA").

Reporting alleged copyright infringement

If you believe content on the Service infringes a copyright you own or control,
send a written notice to our Designated Agent (below) that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim has been infringed.
  3. Identification of the material that you claim is infringing, with enough detail
    for us to locate it (for example, the URL).
  4. Your contact information (address, telephone number, and email).
  5. A statement that you have a good-faith belief that the use is not authorized by
    the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is
    accurate and that you are the copyright owner or authorized to act on its
    behalf.

When we receive a valid notice, we will remove or disable access to the material
and make a reasonable effort to notify the member who posted it.

Counter-notification

If you believe your material was removed by mistake or misidentification, you may
send our Designated Agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it
    appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the
    material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to
    the jurisdiction of the federal court for the judicial district in which your
    address is located (or, if outside the United States, any judicial district in
    which we may be found), and that you will accept service of process from the
    person who provided the original notice or their agent.

If we receive a valid counter-notice, we may restore the material in 10–14
business days unless the original complainant notifies us that they have filed a
court action seeking to restrain the activity.

Repeat-infringer policy

We maintain a repeat-infringer policy. Members who are the subject of repeated,
valid infringement notices will, in appropriate circumstances and at our
discretion, have their accounts suspended or terminated. As a general guideline,
three substantiated infringement notices may result in account termination.

Our formal Designated Agent registration with the U.S. Copyright Office and the
agent's postal address are being finalized. In the interim, please send all DMCA
notices and counter-notices to legal@ccmftrains.com.

Misrepresentation

Under the DMCA, any person who knowingly materially misrepresents that material is
infringing, or that it was removed by mistake, may be liable for damages. Please
be sure of your rights before submitting a notice or counter-notice.
